Terms and Conditions of Sale

GENERAL

All quotations are made and all orders are accepted by the company subject to the following conditions:-
Quotations shall be available for acceptance for a period of 30 days from the date of the quote and may be withdrawn by the company within such a period at any time by written or oral notice.

DELIVERY

Alterations to the order by the customer may result in delay of delivery.

The company will endeavour to comply with reasonable requests by the customer for postponement of delivery but shall be under no obligation to do so and may charge the customer with reasonable charges for storage.

The customer must ensure the provision of the company adequate access to the point at which delivery is to take place and all other facilities and services necessary to enable the company to deliver in accordance with the customer’s requirements.

TITLE

Ownership of the goods supplied shall only pass to the customer when the customer has paid the company all sums due and payable under the order. If the customer shall commit and continue to commit a serious breach of this Agreement for 21 days or more, after notice from the company of the breach, the company shall be at liberty to treat this Agreement as cancelled and accordingly may terminate it by notice in writing and recover possessions of the system together with any costs for doing so. PLEASE NOTE this does not apply to installations for rental.

All installation of goods for rental purposes, remain the property of ASSOCIATED STAIRLIFTS LTD. If the customer shall commit and continue to commit a serious breach of this Agreement for 21 days or more, after notice from the company of the breach, the company shall be at liberty to treat this Agreement as cancelled and accordingly may terminate it by notice in writing and recover possessions of the system together with any costs for doing so.

PRICES AND VAT

If any alterations, to the design or specifications of the goods is requested by the customer and agreed by the company an appropriate alteration in the price for the goods may be made by the company.

Goods supplied for individual disabled persons at present are not subject to VAT but VAT may be charged in the event of a change in the law. The company will require a signed declaration of disability.

WARRANTY

This warranty does not affect the statutory rights of the customer but if the customer wishes to have the benefits of the company’s warranty conditions, the customer must comply with the provisions set out below.

In the event of a defect in the goods supplied becoming apparent within the warranty period, the company itself or authorised dealer/ repairs agent will affect any necessary repair or replacement parts free of charge on condition that the customer complies with the following provisions of this warranty.

Any part repaired or repaired during the warranty period is warranted for the duration of that period.

The arrangements for repair and service and the designated repairer will be notified to the customer by the company and will be confirmed at any time on request.

ON A DEFECT OCCURRING DURNG THE WARRANTY PERIOD, THE CUSTOMER MUST NOTIFY THE DESIGNATED REPAIRER AS SOON AS REASONABLY PRACTICABLE GIVING FULL INFORMATION AS TO THE PROBLEM. NO USE MUST BE MADE OF THE GOODS AND NO ALTRATION OR UNAUTHORISED REPAIRS MADE TO THE GOODS PRIOR TO INSPECTION BY A DESIGNATED REPAIRER.

Items of a consumable nature will not normally be covered during the warranty period unless such items have suffered undue wear as a direct result of an original manufacturing defect. These items included amongst other things lubricants, upholstery and similar parts.

Under no circumstances, no responsibility will be accepted where the goods have required repair or replacement as a direct result of:-

  1. The goods or part not having been maintained in accordance with the manufacturers recommendations where such exist and using only the specified original equipment parts.
  2. The goods or part having been damaged by neglect, accident or improper use.
  3. The goods or part having been altered from the manufacturers specifications, or repairs having been attempted prior to the designated repairer being notified.
  4. Fair wear and tear.
